Terms of Use

1. Agreement

These Terms apply when you access or use HVAC HQ, including hvachq.app, its AI-assisted review tools, field tools, community areas, marketplace and related services. By creating an account or using HVAC HQ, you agree to these Terms and our Privacy Policy. If you use HVAC HQ for an organisation, you confirm you are authorised to use it on that organisation's behalf.

2. Decision-support service

HVAC HQ provides AI-assisted technical and commercial decision support for HVAC&R work. It is not a substitute for a licensed trade practitioner, engineer, certifier, legal adviser, manufacturer instruction, site-specific risk assessment, applicable legislation, codes or Australian Standards.

AI output can be wrong, incomplete or out of date. You must verify material findings before relying on them, particularly where electrical safety, refrigerant, gas, pressure systems, fire/smoke systems, working at height, statutory compliance, payment withholding or other high-consequence decisions are involved. You remain responsible for the work you authorise, perform, approve, reject or pay for.

3. Accounts and acceptable use

You must provide accurate account information, keep login credentials secure and use HVAC HQ lawfully. You must not:

• upload information you are not authorised to use or disclose;
• use the service to infringe privacy, copyright, confidentiality or other rights;
• attempt to bypass plan limits, access controls, security measures or another user's records;
• interfere with the service, upload malicious content, scrape protected data or misuse automated interfaces; or
• present AI-generated output as an authoritative certification, statutory approval or engineering sign-off when it is not one.

4. Your content

You retain your rights in content you upload or create. You grant HVAC HQ and its service providers the limited permission needed to host, process, analyse, transform and return that content so the requested feature can operate. You are responsible for ensuring you have the rights and permissions required for uploaded contracts, reports, photos, standards, manuals, client information and other materials.

5. Subscriptions, launch offer and renewal

Eligible new accounts may receive the advertised 60-day launch offer after completing account verification. The offer provides Full Usage access without a card for the stated period and is available once per account. If you later choose a paid plan, billing starts at checkout in Australian dollars at the price shown, plus GST where applicable. The subscription then renews automatically on the selected monthly or annual cycle until cancelled.

You can manage payment details and cancel a subscription through the billing portal available from HVAC HQ. Access to paid features may continue until the end of a paid period after cancellation, subject to the applicable Stripe billing state. We will not knowingly create a second active HVAC HQ subscription for the same account through our normal checkout flow.

6. Pricing, refunds and Australian Consumer Law

Prices, plan inclusions and promotional offers may change for future purchases or renewal periods. We will not exclude, restrict or modify any consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law. Where a refund or other remedy is required by law, that right applies. For billing questions, contact hello@hvachq.app.

7. Community and marketplace

Community posts are user-generated content. Do not post client names, private site information or material you are not authorised to share. Marketplace and sponsored listings are promotional content from third parties unless stated otherwise. A featured listing is not an HVAC HQ endorsement, technical approval or warranty of the advertiser, product or service.

8. Third-party services

HVAC HQ relies on third-party services, including Base44 for application infrastructure and Stripe for payments. External websites, supplier links and third-party services have their own terms and privacy practices. Availability of those services can affect HVAC HQ functionality.

9. Availability and changes

We aim to keep HVAC HQ reliable but do not promise uninterrupted or error-free availability. We may maintain, improve, replace or discontinue features where reasonably necessary. Material subscription changes will be presented transparently and nothing in these Terms permits conduct that would be unlawful or misleading.

10. Liability

To the maximum extent permitted by law, HVAC HQ is not responsible for losses caused by relying on unverified AI output, user-supplied information, third-party content or decisions made outside the platform. Nothing in these Terms excludes or limits liability or rights that cannot legally be excluded or limited.

11. Suspension and termination

We may suspend or restrict access where reasonably necessary to address security risks, misuse, non-payment, unlawful use or material breaches of these Terms. You may stop using HVAC HQ at any time and can cancel paid subscriptions through the billing portal.
